When should I hire that attorney? You should hire an experienced D.U.I. attorney as soon as possible after your arrest to protect and insure that your legal rights are protected and also to file any motions and/or subpoena that will be important for your defense. Also if there is no way to win your summary suspension or you choose not to contest it, you maybe eligible for a M.D.D.P. so you can drive during your summary suspension. A D.U.I. is a criminal offence punishable by up to 364 days in jail and/or a fine of up to $2,500.00 and revocation of your driver's license if convicted. The period of suspension can range from six months to three years depending on whether the motorist submitted to testing or refused and whether they have a prior D.U.I. or a summary suspension within the last five years.
